The woman who alleged Jay-Z and Diddy sexually assaulted her when she was 13 has filed a motion to throw out the defamation lawsuit Hov brought against her, according to TMZ.
On Tuesday, she submitted new court papers seeking dismissal of Jay’s defamation case against both her and her attorney Tony Buzbee. In her filing, she argues Jay can’t sue her because her accusations were made in official court documents, and she used her NBC interview to ensure the “fair report privilege,” a legal protection that guards individuals from defamation claims when allegations are accurately reported.
“The average person watching the report, and indeed anyone watching the report, would certainly understand that the statements refer to allegations in the lawsuit,” her legal team stated in the documents.
Buzbee also moved to have Jay’s lawsuit against him dismissed, claiming they reached an agreement that the rapper later backed out of. Jay and his legal team have denied making any deal with Buzbee.
Jay sued the woman for defamation, malicious prosecution and other wrongdoing in March after she dropped her initial December lawsuit accusing him and Diddy of assaulting her when she was just 13. In his legal action, Jay claimed the woman and Buzbee were running an “evil conspiracy” to extort money from him.
“Mr. Carter does not commence this action lightly,” Jay’s lawyers wrote at the time. “But the extortion and abuse of Mr. Carter by Doe and her lawyers must stop.”
Jay-Z has claimed that the dismissed case cost him $20 million in lost income.
