Sia’s Estranged Husband Seeks Sole Custody, Citing Alleged Drug Abuse

Sia’s estranged husband, Daniel Bernad, has reportedly filed for sole custody of their 1-year-old son, Somersault Wonder Bernad.

According to legal documents obtained by TMZ, Bernad claimed the 49-year-old “Chandelier” singer poses a “serious and immediate” danger to their child.

“Sia is an unfit and unreliable parent struggling with substance abuse and addiction, rendering her incapable of providing safe or stable care for Summi,” Bernad stated in the filing.

He argued that he is the “only safe and reliable parent” and asked the court to order Sia to undergo random drug testing and restrict her to three, two-hour professionally supervised visits per week.

In response, Sia argued that there’s no emergency requiring a custody change, emphasizing that their son has been safe in her care since the separation. She also pointed out that back in August 2025, both parties agreed Bernad would have limited, monitored visits due to an active Los Angeles Police Department and family services investigation into “illicit child pornography” allegedly found on his computer.

Sia said she pushed for supervised visits after learning about the investigation, while Bernad denied the allegations and accused her of “planting evidence” to restrict his access to their child.

Bernad further alleged that Sia failed to disclose a recent two-week hospital stay where she allegedly tested positive for barbiturates and benzodiazepines. He’s seeking $77,245 per month in child support, claiming he has no current income because Sia “ceased all funding” for their joint venture, Modern Medicine.

Once an oncologist, Bernad said he is now unemployed and financially dependent on Sia, who he described as having an “extremely successful and long music career.”

Sia countered that she’s been sober for over six months and continues to comply with drug testing, while claiming Bernad has refused regular tests. She acknowledged her past struggles with addiction 15 years ago, calling her recovery a “cornerstone” of her life.

“Dan’s attempt to weaponize my past sobriety journey … serves no legitimate purpose and is intended only to distort the facts and undermine my credibility,” she told the court.

Sia added that she’s open to expanding Bernad’s visitation time if supervised by a trusted caretaker like his mother or a nanny but opposes any drastic changes to their existing custody arrangement.

TMZ reported that Sia filed for divorce in March after two years of marriage, citing “irreconcilable differences.” She requested both legal and physical custody of their son while allowing visitation rights for Bernad.

This marks Sia’s second divorce—she previously split from filmmaker Erik Lang in 2016.

As Billboard reported, Bernad’s earlier spousal support filing dated Oct. 10 claimed he was owed over $260,000 per month from Sia, describing their former life together as “luxurious and upper-class,” with more than $400,000 in monthly expenses on private jets, fine dining, and full-time staff.
