Prosecutors Are Pushing for Kay Flock to Receive a 50-Year Prison Sentence

Federal prosecutors are pushing for New York rapper Kay Flock to spend 50 years behind bars after he was convicted on three federal racketeering charges.

In March, Flock was found guilty of racketeering conspiracy, assault with a dangerous weapon and attempted murder in aid of racketeering, and a firearm discharge offense. His sentencing is scheduled for Dec. 16.

In their filing to Judge Lewis J. Liman, prosecutors argued that Flock acted as the leader of a “violent street gang,” using his influence to “transform the neighborhood gang Sev Side into a highly visible, influential, and violent entity.”

“Over the course of less than 18 months, [Flock] and his fellow gang members engaged in a campaign of violence, deepening existing gang rivalries and instigating new feuds where none had previously existed,” Assistant U.S. Attorney Michael R. Herman wrote. “Dozens of people were shot at, injured, and even killed during this short period of time, due to the increased gang violence whipped up, in large part, by [Flock].”

The 18-page submission details the government’s claims that Flock built up Sev Side by recruiting people to carry out shootings, while also tying him to multiple violent incidents.

Prosecutors also pointed to an Instagram post Flock made after the trial in which he wrote, “I beat the top count I made the judge cry… Kill all rats!!!!” — referencing his acquittal on the most serious charge, murder in aid of racketeering. They say the post reflects “a complete disregard for the law.”

Their recommended 50-year sentence includes 20 years each for the racketeering and assault counts, plus 10 years for the firearm charge.

The government’s filing comes ahead of the rapper’s long-delayed sentencing, originally set for October but postponed at the request of his attorney, Michael T. Ashley, who said they needed more time to obtain key materials for Flock’s sentencing submission.
