California is seeking to have Tory Lanez’s $100 million federal lawsuit over his prison stabbing dismissed.
According to court documents, Attorney General Rob Bonta’s office filed a motion on Wednesday (July 29) asking a federal judge to reject all claims against the California Department of Corrections and Rehabilitation. The state argues that the agency cannot legally be sued under the federal law Lanez is using for his case. The Attorney General’s office specifically cited the Eleventh Amendment, which provides states with immunity from certain lawsuits filed in federal court.
The amendment states, “The Judicial power of the United States shall not be construed to extend to any suit in law or equity, commenced or prosecuted against one of the United States by Citizens of another State, or Citizens or Subjects of any Foreign State.” The AG’s office further argued that the protection also applies when a state is sued by one of its own residents.
The motion is asking the court to dismiss Lanez’s claims entirely without allowing his legal team to revise the complaint.
A hearing on the dismissal request has been scheduled for August 26 at a federal court in Los Angeles.
The 34-year-old rapper and singer, whose real name is Daystar Peterson, filed the lawsuit on April 14, claiming he was attacked by another inmate using an improvised weapon at the California Correctional Institution on May 12, 2025.
Lanez, who is currently serving a 10-year sentence for the shooting of Megan Thee Stallion, alleged in his lawsuit that he suffered permanent facial scars and two collapsed lungs after being stabbed 16 times.
He also claimed prison officials were aware that the alleged attacker had a “violent history” and should not have placed him near Peterson, arguing that his “high-profile celebrity status” made him a clear target.
The lawsuit further alleges that correctional officers were not present during the attack, failed to properly respond afterward, delayed medical care, and later wrongfully took Peterson’s belongings after he was moved to another facility.
Lanez claimed that notebooks containing unreleased lyrics with “substantial commercial value,” along with legal notes prepared for his attorney, were taken while he was recovering in the hospital.
His $100 million lawsuit includes a demand of $1 million for each stab wound and an additional $10 million for the facial scarring he says he suffered.
