Jack Doherty Could Be Looking at Up to Seven Years Behind Bars Following His Latest Arrest

Streamer Jack Doherty is now facing three major charges after being arrested over the weekend in Miami, following a clash with police while filming content.

During the search, officers found “half of an orange oval shaped pill with a 3 on it,” which they said was “consistent with” an amphetamine, according to the arrest affidavit. They also discovered three hand-rolled “suspected cannabis cigarettes.”

With the drug findings and what authorities described as Doherty “refusing officers[’] commands in a nonchalant manner,” he was hit with three charges: possession of a controlled substance (the amphetamine), possession of 20 grams or less of marijuana, and resisting an officer without violence.

The controlled substance charge is a third-degree felony, while the other two are first-degree misdemeanors. Under Florida law, a third-degree felony can bring “a term of imprisonment not exceeding five years,” and a first-degree misdemeanor can carry up to one year.

If convicted with maximum penalties on all counts, Doherty could technically face up to seven years behind bars.

Still, that outcome is very unlikely. A Measures for Justice report analyzing Miami-Dade County data from 2012–2013 found the median prison sentence for nonviolent felony convictions—among people with no prior Florida convictions within three years—was 24 months.

Even more telling, fewer than 8.5 percent of that group received any prison time at all, despite a conviction rate of over 58 percent.

Since the incident, Doherty has continued streaming.
