D4vd saw his criminal case pushed back once again this week after a Los Angeles judge delayed his preliminary evidentiary hearing for another month.
During a status conference on Tuesday, May 12, the 21-year-old singer, born David Anthony Burke, appeared in court wearing an orange jail jumpsuit as attorneys discussed scheduling issues tied to the murder case involving 14-year-old Celeste Rivas Hernandez.
According to TMZ, the “Romantic Homicide” artist reportedly appeared calm throughout the hearing and was even seen slouching in his chair while lawyers debated the timeline surrounding the case.
D4vd only briefly addressed the court to acknowledge the delay, with the evidentiary hearing now officially rescheduled for June 29. Another status hearing is currently set for June 17, 2026.
The Withered singer is facing charges that include first-degree murder, continuous sexual abuse of a child, and unlawful mutilation of human remains connected to the death of Rivas Hernandez.
Prosecutors allege the musician first met the teenager when she was 11 years old before allegedly beginning a sexual relationship with her at age 13. Authorities further claim he continued communicating with her even after allegedly being informed of her real age.
The latest court appearance follows the release of a disturbing nine-page evidentiary brief from prosecutors outlining their theory of the alleged crime.
According to court filings, prosecutors claim D4vd arranged for an Uber driver to bring Rivas Hernandez to his Hollywood Hills rental property on April 23, 2025. Authorities allege he fatally stabbed her in an attempt to stop her from exposing their relationship and damaging his music career.
Investigators also allege D4vd purchased chainsaws, a shovel, a body bag, and a blue inflatable pool as part of an effort to dismember and hide the victim’s remains.
Prosecutors further claim he stored the remains inside his Tesla for several months and, according to Rolling Stone, allegedly “lied to friends, business associates, and others who noticed the strong smell of decay in and around his home and vehicle.”
Authorities reportedly discovered the decomposed remains in September 2025 after the vehicle was impounded and towed.
At a previous hearing on April 29, D4vd’s attorney, Blair Berk, reminded the court that her client is “presumed innocent.”
D4vd has pleaded not guilty to all charges, including special-circumstance allegations involving murder of a witness, financial gain, and lying in wait.
If convicted, the singer could face either life in prison without parole or the death penalty.
