The case involving Kim Zolciak’s 15-year-old son took a disturbing turn on Friday, September 11, after prosecutors revealed that he was already under court supervision over a previous sexual battery charge before his August arrest.
During Kroy “KJ” Biermann Jr.’s bond hearing in Fulton County Superior Court, Deputy District Attorney Caitlin McGillicuddy alleged that investigators discovered several videos on his cellphone that appeared to show him engaging in penetrative sex with a relative under 12, according to The New York Post. She claimed the recordings documented multiple encounters and showed KJ using “predatory, derogatory” language toward the child.
McGillicuddy told Judge Melynee Leftridge that KJ had been under court supervision since October 2025 over a sexual battery charge involving the same relative. The charge had not been publicly disclosed until Friday’s hearing.
“This would now mark the second time he has been charged with an offense of a sexual nature of a very serious kind which involves female victims,” McGillicuddy said.
The revelation significantly raised the stakes in KJ’s attempt to be released from the Metro Regional Youth Detention Center, where he has remained since Aug. 17. Defense attorney Jason Sheffield proposed a $65,000 bond, telling the court that Zolciak could supervise her son because she is currently at home and unemployed. Prosecutors, however, sought a $190,000 bond. Leftridge ultimately set KJ’s bond at $200,000, according to Page Six.
“This has been so traumatizing to him personally,” Sheffield said. “He is not a boisterous kid. He is somewhat quiet.” In an earlier filing, the attorney portrayed KJ as a strong student, active member of his community and talented football player who has received scholarship offers.
The court also heard from the 15-year-old classmate at the center of KJ’s current seven-count indictment. In a statement read in court, she said she was “living in fear” because of alleged threats that KJ would retaliate if he were released.
“I am not only scared for myself anymore, I am scared for my family, too,” she wrote, saying that relatives had received emails and phone calls connected to the case. “The people that I love should not have to be afraid or be dragged into this.” Prosecutors additionally claimed that the girl sustained a “documented physical injury” during what McGillicuddy described as a “predatory” assault.
KJ was indicted Sept. 3 on charges of aggravated child molestation, aggravated sodomy, aggravated sexual battery, false imprisonment and three counts of sexual battery against a child under 16.
The charges are tied to an alleged April 23 incident at a Life Time Fitness facility in Alpharetta, Georgia. His classmate alleged that he forced sexual contact despite her repeatedly refusing. A subsequent medical examination did not recover any male DNA.
Sheffield has continued to insist that KJ is “100 percent innocent” and said he intends to enter not-guilty pleas at his Oct. 14 arraignment. He is also asking for the case to be transferred to juvenile court, arguing that KJ was 14 at the time of the alleged gym incident and could otherwise receive a mandatory minimum sentence of 25 years without parole if convicted as an adult.
Zolciak, Kroy Biermann and their daughter Brielle were all present at the hearing. The Real Housewives of Atlanta alum previously called the gym allegations “reckless and deeply troubling,” pointing to her son’s polygraph results and the lack of DNA evidence. She has not publicly commented on the separate case disclosed in court.
